1. Agreement to Terms
By downloading or using Activ365 ("the App"), you agree to be bound by these Terms and Conditions. If you do not agree, do not use the App. These terms are governed by the laws of New South Wales, Australia.

2. Licence to Use
We grant you a personal, non-exclusive, non-transferable, revocable licence to use the App on any Apple device you own or control, subject to these Terms and the Apple App Store Terms of Service.
You may not:
- Copy, modify, or distribute the App or its content
- Reverse-engineer or attempt to extract the source code
- Use the App for any commercial purpose without our written consent
- Remove any copyright or proprietary notices
3. Subscription and Pricing
Activ365 is offered as a subscription app. Access to the full app requires an active Activ365 Monthly Premium subscription at $5.99 AUD/month (or the equivalent price in your local currency as shown in the App Store).
New subscribers receive a 3-day free trial. After the trial period ends, your subscription will automatically renew at the standard monthly price unless cancelled at least 24 hours before the end of the current billing period.
All payments are processed by Apple through the App Store. Your subscription can be managed or cancelled at any time in your Apple ID account settings: Settings → [Your Name] → Subscriptions.
- Subscription automatically renews unless auto-renewal is turned off at least 24 hours before the end of the current period
- Your Apple ID account will be charged on confirmation of purchase
- Any unused portion of a free trial is forfeited when you purchase a subscription
- Prices may vary by country and are subject to change with notice
4. Your Data
All workout data, goals, and preferences you enter into the App are stored exclusively on your device. We have no access to this data. You are solely responsible for backing up and managing your data. Uninstalling the App permanently deletes all locally stored data.

5. Accuracy of Information
Activ365 is a personal tracking tool. It is not a medical device and does not provide health, medical, or fitness advice. The goal-tracking and workout-logging features are for motivational and organisational purposes only. Always consult a qualified health professional before beginning any exercise programme.
6. Disclaimer of Warranties
The App is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the App will be error-free, uninterrupted, or free of viruses or other harmful components.
7. Limitation of Liability
To the maximum extent permitted by applicable law, Nano Synapsys shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the App — including loss of data.
Our total liability to you for any claim arising out of or relating to these Terms or the App shall not exceed AUD $10.
8. Intellectual Property
All intellectual property rights in the App — including its design, code, branding, and content — are owned by or licensed to Nano Synapsys. Nothing in these Terms transfers any intellectual property rights to you.
9. Updates and Modifications
We may update the App at any time to add features, fix bugs, or address security issues. We may also modify these Terms at any time. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of the App after changes constitutes acceptance of the updated Terms.
10. Termination
We reserve the right to discontinue the App at any time without notice. You may stop using the App at any time by deleting it from your device.
11. Third-Party Terms
The App is distributed via the Apple App Store. Your use is also subject to Apple's Standard End User Licence Agreement (EULA). Apple is a third-party beneficiary of these Terms and has the right to enforce them.
12. Governing Law
These Terms are governed by the laws of New South Wales, Australia. Any disputes shall be resolved in the courts of New South Wales, and you consent to the exclusive jurisdiction of those courts.
